These Terms of Service ("Terms") govern your use of PresentationMate ("Service"), operated by PresentationMate ("Company", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
1. Description of Service
PresentationMate is a presentation practice tool that provides:
- Audio recording and real-time transcription of your practice sessions
- AI-powered feedback on your presentation delivery and grammar
- Storage of your practice session history
The Service is intended for individual, personal use only.
2. Account Registration
To use the Service, you must:
- Be at least 18 years old (or the age of majority in your jurisdiction)
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized account access
You are responsible for all activities that occur under your account.
3. Subscription and Payment
3.1 Pricing
The Service is offered as a paid subscription. Current pricing is displayed at checkout and may vary by region. All prices are in US dollars unless otherwise stated.
3.2 Billing
- Subscriptions are billed monthly in advance
- Payment is processed by Stripe, Inc.
- You authorize us to charge your payment method on a recurring basis
3.3 Usage Limits
Some subscription tiers include monthly usage limits. Usage resets at the beginning of each billing cycle. Unused usage does not roll over.
3.4 Cancellation
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- No refunds are provided for partial billing periods
3.5 Price Changes
We may change subscription prices with 30 days' notice. Continued use after a price change constitutes acceptance of the new price.
4. Acceptable Use
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Upload or transmit malicious code or content
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Share your account with others or resell access
- Use automated means to access the Service (bots, scrapers)
- Record or transcribe content you do not have rights to
We reserve the right to suspend or terminate accounts that violate these terms.
5. Intellectual Property
5.1 Our Property
The Service, including its design, features, and content (excluding your content), is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.
5.2 Your Content
You retain ownership of the content you create using the Service, including your audio recordings, transcripts, and any text you input. By using the Service, you grant us a limited license to process this content solely to provide the Service to you.
6. Privacy and Data
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. AI-Generated Content
The Service uses artificial intelligence to generate feedback on your presentations. You acknowledge that:
- AI feedback is provided for informational and educational purposes only
- AI-generated content may contain errors or inaccuracies
- You should not rely solely on AI feedback for professional or consequential decisions
- We do not guarantee the accuracy, completeness, or usefulness of AI-generated feedback
8. Third-Party Services
The Service integrates with third-party services including:
- Stripe (payment processing)
- Clerk (authentication)
- AssemblyAI (transcription)
- Anthropic (AI feedback)
Your use of these services is subject to their respective terms and privacy policies.
9. Service Availability
9.1 Availability
We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
9.2 Modifications
We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes when possible.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT TRANSCRIPTIONS OR AI FEEDBACK WILL BE ACCURATE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or violation of any rights of a third party.
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
13.2 Informal Resolution
Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days.
13.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive any right to participate in class actions.
14. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
- Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment: You may not assign these Terms without our written consent. We may assign these Terms without restriction.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date.
